法規內文(Content)

Article 1
Where there is a need to underwrite a series of products related to personal injury insurance in such a manner that the parties are yet to be named, clauses consistent with the provisions set forth in these Regulations must be expressly stated in each set of policy provisions or proposal for each such insurance product.

Article 2
Proposal must be made in the like manner as a proposal for group insurance, with a business entity submitting application for this insurance directly to an insurance company for and on behalf of the proposers.
The proposers are then to be the insureds.

Article 3
In addition to being determined in the manner provided in Article 132 of the Insurance Act, the method for determining insureds may also be specified in each personal injury insurance contract's relevant policy provisions or among the declarations on the proposal for each such contract.

Article 4
May be no person other than an insured himself or his legal heir.

Article 5
To make a claim for insurance benefits, a beneficiary may apply to the insurance company by presenting the policy or a transcript thereof or other documentary proof.
An insurance company may only settle a claim by issuing to a beneficiary a non-transferable check made to order of the beneficiary, and shall make such payment directly to the beneficiary.
The provisions set forth in the two preceding paragraphs shall be expressly set forth in the contract by incorporating such provisions into the contract's policy provisions or by specifying them in the contract as an additional condition.

Article 6
Signs must be erected or posters posted at the entrance to construction sites, recreational areas, conveyances, or the like to inform insureds that this insurance has been arranged on their behalf. Such signs and posters shall contain such language as shown in Annex 1 through 3 hereto. Any admission tickets or entry passes that are issued shall include at an appropriate place an indication that authorization has been given to arrange the insurance on their behalf.
The manner of public notice as set forth in the preceding paragraph shall be listed among the underwriting factors to be used as the basis for effecting insurance cover.
